What We Do !!!

Patents in India

A patent in India is a statutory right granted for an invention that is new, involves an inventive step, and is capable of industrial application. The Indian patent system is governed by the Patents Act, 1970 and administered by the Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM). A patent gives the inventor exclusive rights to prevent others from making, using, selling, or importing the patented invention without permission for a period of 20 years from the filing date. Patents play a vital role in encouraging innovation, technological advancement, and commercialization of inventions in India.

Industrial Designs in India

Industrial design protection in India covers the aesthetic or ornamental aspects of an article, such as shape, configuration, pattern, or surface decoration, which are judged solely by the eye. Designs are protected under the Designs Act, 2000. The objective of design registration is to protect the visual appearance of products and prevent unauthorized copying. A registered design is initially protected for 10 years, which can be extended by an additional 5 years. Design protection helps manufacturers gain a competitive advantage by safeguarding product appearance.

Copyrights in India

Copyright in India protects original literary, artistic, musical, and dramatic works, as well as cinematograph films, sound recordings, and computer software. It is governed by the Copyright Act, 1957. Unlike patents, copyright protection arises automatically upon creation of the work, though registration serves as legal evidence. The duration of copyright protection generally lasts for the lifetime of the author plus 60 years. Copyright ensures creators are rewarded for their intellectual efforts and encourages creativity in art, literature, and technology.

Trademarks in India

A trademark is a distinctive sign, symbol, word, logo, or combination thereof used to identify and distinguish goods or services of one business from another. Trademarks in India are governed by the Trade Marks Act, 1999. Registration grants the owner exclusive rights to use the mark and to take legal action against infringement. A registered trademark is valid for 10 years and can be renewed indefinitely. Trademarks help build brand identity, consumer trust, and goodwill in the marketplace.

Geographical Indications (GIs) in India

Geographical Indications are signs used on products that originate from a specific geographical region and possess qualities or reputation due to that origin. In India, GIs are protected under the Geographical Indications of Goods (Registration and Protection) Act, 1999. Examples include Darjeeling Tea, Kanchipuram Silk, and Basmati Rice. GI registration provides legal protection against misuse and promotes rural development by preserving traditional knowledge and local craftsmanship. The registration is valid for 10 years and is renewable.
